Terms and Conditions
These Terms & Conditions form the basis of a Contract between You and The Company. Please take the time to read through this document carefully; the following words have the following definitions:

‘The Company’ means Baby Band

‘We’ ‘Us’ or ‘Our’ means The Company

‘Guardian’ means a person other than a parent who brings the child to the class

‘You’ or ‘Your’ means the person(s) accepting this Contract
-
‘Course’ means a block of classes or classes running once each week concurrently.

‘Classes’ or ‘Lessons’ means a single event lasting a specific amount of time.

‘Instructor’ or ‘Teacher’ means an Employee provided by The Company who shall teach the class
-
‘Premises’ means the venue in which your Baby Band class is held.
Please note, we publish and confirm exact dates and times of your classes in your account and at the time of booking via email. By making a booking and payment, you agree to our terms and conditions and to attend your classes for the whole term, pass duration or course.
General Rules
A copy of the Company public liability insurance policy is available upon request. You will remain responsible for your child at all times throughout each class. Children must not run or act inappropriately within any part of the Premises. We will not be responsible for any injury or accident caused as a result of children and/or parents failing to abide by these rules and supervise their children at all times, in all parts of the building. Photography is permitted but only of your child. Safety is our first concern and we reserve the right to remove anyone from the class should we feel that safety is in any way compromised.
Renewal of Classes
Within the last 2 weeks of each block, we will email you details of the next available block. This email will contain information about the block start date, the date on which renewal will begin and payment deadline dates. If you want to change time or day or stop altogether, you must advise us in writing before the deadline.
Payments, Vouchers and Promotions
Payments:
Payment is due before the start of all lessons. Payment due dates are published and emailed with regularity. Once your space has been renewed you will receive a confirmation email and payment receipt. Our preferred method of payment is via a bank transfer (BACS). You will be issued with an invoice containing payment dates and details.
Payments must be made for the entire block as defined by the website when booking. Classes can not be paid for on an individual basis.
Vouchers:
Vouchers are non-refundable, are not exchanged for cash and are not transferable to other Baby Band customers. They are valid for 12 months from the date of purchase. When redeeming, please bring the voucher with you or quote the barcode number on the card to Charlotte Hill. If we can’t find you a space in one of our classes or courses straight away, we can credit your account to the value of the voucher for future use.
Promotions & Offers:
Promotions and offers are non-refundable, are not exchanged for cash and are not transferable to other Baby Band customers. They are valid for the duration of the promotion as stated at the time of communication, and cannot be redeemed in conjunction with other offers. When redeeming, please quote the promotional reference contained in our correspondence. We reserve the right to withdraw promotional codes at any time.
Refunds and Cancellations
Baby Band is under no obligation to refund or transfer any monies in the event that you are unable to attend part of, or the entire block. If we cancel a class for any reason, we will add the cancelled class onto the end of your block. If you cancel your booking for the next block within 10 days of the commencement date of the block (up until 4pm the evening before) we will issue you a refund minus an administration charge of £30.00. If you cancel your booking for the next block prior to 10 days we will issue you a refund minus an administration charge of £5.00. Once the block has started, we are unable to offer any refund and 100% cancellation fees are applicable.
We are not responsible for delays outside our control including, without limitation: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) epidemic or pandemic (including any existing epidemic or pandemic); (c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation of war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority; (f) collapse of buildings, fire, explosion or accident; (g) any strikes, industrial action or lockouts; (h) non-performance by suppliers or subcontractors; and (i) interruption or failure of utility service. If our supply of the services is delayed by an event outside our control, then we will:

contact you as soon as possible to let you know;

take steps to minimise the effect of the delay (where possible); and

Add any missed classes onto the end of a block
Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any services you have paid for but not received.
Parties
A non-refundable deposit of £25 must be paid to secure the booking. The remaining cost must be paid in full no later than 2 weeks before the party.
For cancellations within 2 weeks of the party we are unable to offer any refund and 100% cancellation fees are applicable.
Holidays
If you wish to take a holiday during the course or term, you will still be charged for the full block. You will then retain your place in the class for that block.
Complaints
In the event of a complaint arising, you should initially approach Charlotte Hill. Failing a satisfactory resolution, Peter Hill and David Wood will become involved to satisfy the complaint.
Our Guarantee
We guarantee to provide safe, child-led, quality classes that enhance bonding, build confidence and increase musical development and ability, using suitably qualified music teachers at all times.
Liabilities
The Company is not liable for any damage or loss to property whilst in the premises or within the grounds/car park of the premises. The Company will not accept any liability for any accident or injury (including any fatality) to any parent, child, guest or visitor that may occur on the premises or within the grounds/car park of the premises, other than liability which may arise from the negligence of the Company, its staff or its agents. Any such incidents must be reported to the Company immediately.
Photographs
Video footage and photographs may be taken at any and all classes and events hosted by Band Band by staff which may be used in the public domain for promotional purposes. Please inform us if you do not give your permission for an image of you and/or your child to be used in this way. Baby Band cannot be held accountable for videos and photographs taken by other parties.
